Active-duty military members who were 18 or older as of Sept 1, 2019 are grandfathered and may purchase tobacco. Photo ID must be checked for any purchaser appearing under 30. Compliance checks are conducted by the Texas Department of State Health Services (DSHS) Tobacco Prevention and Control Program.
Selling to a minor under 21 carries fines of $250 (first violation), $500 (second), $1,000 (third), and up to $5,000 for fourth and subsequent offenses within 3 years. Retailer permits may be suspended or revoked after repeated violations. Failure to post age-of-sale signage is a separate $100 fine. Furnishing tobacco to minors is a Class C misdemeanor under Texas Health & Safety Code Β§161.082.
