New York Public Health Law Section 1399-aa raised the minimum age for tobacco, vaping, and herbal products to 21 statewide, applying to all retailers in Nassau County since 2019.
NY Public Health Law 1399-aa prohibits the sale or distribution of tobacco products, herbal cigarettes, liquid nicotine, electronic cigarettes, and vapor products to anyone under 21 years of age. Retailers in Nassau County must verify photo identification for any purchaser appearing to be under 30. Nassau County has long enforced robust age compliance through NCDOH and Department of Consumer Affairs sting operations, with additional local penalties on top of state fines. The state law mirrors the federal Tobacco 21 standard, and there is no exception for military service members under 21.
Selling tobacco or vape products to underage buyers can lead to fines, license suspension, and points against the retail dealer registration under NY law.
