NJ P.L. 2019 c. 271 (codified at NJ Β§2A:170-51.4) banned the sale of flavored electronic smoking devices and e-liquids effective April 20, 2020. The ban covers all flavors except tobacco β including menthol, mint, fruit, candy, dessert, and beverage flavors. The law applies to nicotine and non-nicotine vapes. Combustible flavored cigars and hookah were excluded from this particular ban (but still subject to age-21 rules). Newark Department of Health enforces alongside NJ Division of Taxation. The ban does not apply to flavor descriptors permitted federally; it applies to actual flavor characteristics.
Civil penalties up to $1,000 first offense, $2,500 second, $5,000 subsequent. Newark may suspend or revoke local tobacco retail licenses under Title 14 enforcement.
