Illinois has not enacted a statewide ban on flavored cigarettes, e-cigarettes, or menthol products. The Prevention of Tobacco Use by Persons under 21 Act (720 ILCS 680) and Smoke Free Illinois Act (410 ILCS 82) regulate age and indoor use but do not preempt local flavor bans. Home rule units under Article VII Section 6 of the Illinois Constitution may pass stricter rules. Chicago restricts flavored e-cigarettes within 500 feet of schools, and Evanston bans most flavored tobacco sales. State law continues to follow federal FDA characterizing flavor restrictions for cigarettes.
Local violations vary, with Chicago imposing fines up to $1,000 per offense and license suspension; statewide tobacco license penalties may also apply for noncompliance.
