Amarillo has no independent local vape-retail licensing ordinance. E-cigarette retailers in Amarillo must comply with Texas Health and Safety Code Chapter 147, which requires a state-issued permit for each retail location effective January 1, 2022.
Amarillo has not enacted a standalone municipal ordinance governing vape or e-cigarette retail licensing. State law controls: Texas Health and Safety Code Ch. 147 (E-Cigarette Retailer Permits), enacted via SB 248 (87th Legislature), requires any person selling, storing, or delivering e-cigarette products to consumers to obtain a permit from the Texas Comptroller for each place of business. The biennial permit fee is $180. A separate cigarette and tobacco retailer permit is required under Tax Code Ch. 154–155. Local smoke-free rules in Amarillo are limited; the city has not adopted a comprehensive indoor air quality ordinance covering vaping, unlike cities such as Austin or El Paso.
Selling e-cigarettes without a state permit carries a civil penalty up to $2,000 per day per location under Texas Health and Safety Code Sec. 147.0151. Criminal charges are also possible.
