LAMC chapter IV article 6 section 46.85 (Tobacco Retailer Permit ordinance, Ord. 184274) requires any retailer selling tobacco or vaping products in Los Angeles to hold an annual city permit and post the certificate at the point of sale. Permits are issued by the Office of Finance and contingent on zoning, age-verification, and freedom from flavored-product violations. Retailers must also hold a CDTFA cigarette and tobacco products license under state Business and Professions Code section 22972. Self-service displays of vape products are barred, and PMTA-listed devices and tobacco-flavored e-liquid only may be sold; menthol, fruit, mint, and other flavors are illegal under LAMC section 46.84.
Selling vape products without an LA permit, or selling flavored e-cigarettes, is a misdemeanor and triggers permit suspension or revocation, plus civil fines of up to several thousand dollars per LAMC section 46.85.
