Delaware requires a tobacco retailer license under Title 30 to sell vape and electronic smoking devices, and Wilmington retailers must also hold a city business license. Sales to under-21 buyers and unlicensed sales are prohibited.
Vape shops and convenience stores in Wilmington that sell electronic smoking devices, e-liquid, or nicotine pouches must hold a Delaware tobacco retailer license issued through the Division of Revenue under Title 30 Chapter 53, plus a Wilmington business license under City Code Chapter 5. Retailers must store products behind the counter or in age-restricted areas, train staff on ID checks under DE 30 Β§5301, and remit applicable wholesale taxes. State inspectors and Wilmington L&I both perform compliance checks.
Unlicensed vape sales are misdemeanors with fines, product seizure, and possible business license suspension by the city.
