Under Pennsylvania's Act 101, larger and denser Berks municipalities must run recycling programs. Fifteen Berks municipalities are mandated to recycle under Act 101 with curbside programs, and seven more comply under Act 140. The county-wide Act 101 recycling goal is 35%.
Pennsylvania's Municipal Waste Planning, Recycling and Waste Reduction Act (Act 101 of 1988) requires municipalities above a population/density threshold to adopt mandatory recycling programs. In Berks County, 15 municipalities are mandated to recycle under Act 101 and have curbside recycling in place; another 7 are mandated under Act 140 and comply with ordinances and public education. PA DEP's recycling goal is 35%, which Berks has met through improved reporting. The Berks County Municipal Waste Management Plan, revised in 2024, sets the framework. Even where curbside recycling isn't mandated, residents can use the Authority's Leesport drop-off center for paper, cardboard, metal, aluminum, and plastic containers.
In mandated municipalities, failing to separate recyclables can bring a municipal citation and fine under the local Act 101 recycling ordinance; enforcement is municipal.
