Massachusetts Public Shade Trees over 14 inches circumference (~4.5" diameter) receive heightened protection under MGL c. 87 §3. Boston does not maintain a separate heritage-tree registry but manages landmark trees on public land through Parks & Rec.
Under MGL c. 87 §3, every public shade tree 14 inches or greater in circumference at 4 feet from the ground requires a public hearing before removal by the municipal Tree Warden — effectively Massachusetts' statewide heritage-tree protection. Boston Parks & Recreation's Tree Division manages landmark trees on public property and has designated some major specimens (e.g., the American Elm on Boston Common, historic trees in the Emerald Necklace park system designed by Frederick Law Olmsted) for enhanced protection. The Boston Common's trees, along with those in the Public Garden, Commonwealth Avenue Mall, Copley Square, and the Emerald Necklace, receive special care under the Parks arboricultural plan. Trees within Boston's local Historic Districts (Beacon Hill, Back Bay) are protected by Landmarks Commission design review. MA Arbor Day Foundation "Champion Trees" registry records largest-in-state specimens, some in Suffolk County. The Massachusetts Forest Legacy Program protects private forest parcels; less relevant in urban Suffolk. Damaging a public shade tree during construction (root zone compaction, bark injury) can trigger significant liability under MGL c. 242 §7 timber trespass (triple damages).
Unauthorized removal of public shade tree: up to $500 per tree plus triple stumpage damages (MGL c. 242 §7) that can total tens of thousands. Construction damage to protected trees: remediation plus fines. Historic District tree violations: up to $5,000 under Boston Municipal Code §7-4.10.
