Saratoga Springs and several Saratoga County municipalities regulate removal of street trees and trees in historic districts. Rural towns generally do not regulate private tree removal, but subdivision and site plan approvals impose tree preservation requirements.
Saratoga Springs City Code Chapter 215 (Shade Trees) and the Shade Tree Commission regulate all trees in the public right-of-way β removal requires a permit from the City Forester with no fee for dead/hazardous trees. Private-property trees in the Saratoga Springs Historic District (regulated by City Code Ch. 137 and the Design Review Commission) may require review when removal affects historic character. Clifton Park, Halfmoon, Malta, and Ballston Spa do not regulate routine tree removal on private residential property, but subdivision and site plan approvals under NY Town Law Β§274-a require tree inventories and preservation plans. The Adirondack Park Agency (APA) regulates tree cutting within the Adirondack Park boundary (northern Saratoga County towns of Corinth, Day, Edinburg, Hadley, and Providence) under 9 NYCRR Part 575 and ECL Article 27. Timber harvesting on 25+ acres may qualify for ag exemption. State right-of-way trees along NY-50, NY-9, and I-87 require NYSDOT permission.
Saratoga Springs: Unauthorized street tree removal $250 to $1,000 plus replacement at $100+ per caliper inch. Historic district unapproved removal: up to $500 per tree plus possible stop-work order. APA violations in Adirondack zones: up to $10,000 under ECL Article 71. Private property (non-historic, non-APA): generally no permit needed but subdivision conditions may apply.
