Middlesex County does not issue tree-removal permits for private residential trees. Under NJDEP's 2022 Tier A MS4 stormwater permit, every New Jersey municipality, including all Middlesex towns, had to adopt a tree-removal and replacement ordinance. The NJDEP model triggers an application for removal of any street tree 2.5 inches DBH or larger and any non-street tree 6 inches DBH or larger, requiring replacement plantings or an in-lieu fee. Because the model is a template, each town sets its own sizes, fees and exemptions, so the permit depends on your municipality (Edison, Woodbridge and others differ). Street-right-of-way trees are also controlled by the town's shade tree commission under N.J.S.A. 40:64. The county issues permits only for its own parks and roadsides.
Removing a regulated tree without the required municipal permit can bring fines plus mandatory replacement plantings or an in-lieu payment. County-park and county-road trees may be removed only by Middlesex County.
