The County's formal tree-protection system is Subtitle 25, Trees and Vegetation. Division 2 - the Woodland and Wildlife Habitat Conservation Ordinance - requires a Tree Conservation Plan for the development it covers. Per Section 25-119, a project needs a Type 1 or Type 2 TCP by a qualified professional, unless it earns a Standard Letter of Exemption for lots under 40,000 square feet or with under 10,000 square feet of woodland. Division 3 - the Tree Canopy Coverage Ordinance - separately requires every grading-permit project to provide minimum canopy by zone: about 20% in R-E, R-L and V-L zones, 15% in most residential zones, 10% in commercial zones (Section 25-128). Canopy must be met on-site unless a variance is granted.
Clearing without an approved Tree Conservation Plan, or over 5,000 square feet without a grading permit, violates Subtitle 25. Woodland removed without a permit must be replaced or mitigated. Falling short of tree-canopy coverage blocks permit approval absent a variance.
