Norfolk County has no tree replacement rule. MGL c. 87 Β§7 requires replacement for removed public shade trees. Municipal bylaws in Brookline, Milton require private tree replacement; most other towns do not.
Tree replacement requirements in Norfolk County are municipal. Statewide, MGL c. 87 Β§7 requires that when a public shade tree is removed, the tree warden may require replacement planting or fee-in-lieu. Brookline's Article 8.39 imposes 1:1 replacement for protected tree removals, with replacement calipers of 2-3 inches, from an approved species list. Milton's tree bylaw operates similarly. Most other Norfolk County towns (Quincy, Weymouth, Dedham, Braintree, Randolph, etc.) do NOT have private tree replacement mandates. Fee-in-lieu goes to the municipal tree fund for replanting. Maintenance periods (1-2 years) are sometimes required. Wetlands replication under MGL c. 131 Β§40 may also trigger replacement planting.
No county enforcement. Municipal failure to replace: $250-$1,000 per tree. Unpaid fee-in-lieu: property lien. MGL c. 87 Β§7 violations enforced by tree warden.
