Kanawha County imposes no blanket replant-what-you-cut rule on homeowners. Replacement appears only in Charleston's zoning ordinance, which rewards preserving large trees on a developed site by reducing the number of new trees the project must plant.
West Virginia has no statewide tree-replacement mandate, and unincorporated Kanawha County requires none, so a homeowner removing a yard tree owes no replacement. The one real mechanism is in Charleston's development landscaping rules. Existing trees preserved on a site count toward required landscaping, and for each preserved tree greater than 12-inch caliper the ordinance cuts the number of new trees to be installed by two, an incentive to keep mature specimens rather than a penalty for removal. Street and park tree replacement is handled by the city's Tree City program and its Arbor Day plantings. There is no fee-in-lieu tree fund binding private homeowners in the county.
Failing to install or maintain the landscaping required on a Charleston development site, including required replacement trees, violates the zoning ordinance and can hold up the certificate of occupancy and bring fines. Private yard removals owe nothing.
