Fort Lauderdale requires equivalent replacement for all trees removed under ULDR Section 47-21.15. Trees removed without permits must be replaced with the largest tree reasonably available. The department determines equivalent replacement value based on the size and species of the removed tree.
Under ULDR Section 47-21.15, upon receipt of a tree removal application, the Department of Sustainable Development determines the equivalent replacement or equivalent value of each tree to be removed. Replacement trees must be of appropriate species for the South Florida climate and may include native species required under the Florida-Friendly Landscaping provisions. Trees removed without permits must be replaced with the largest tree reasonably available upon the site. If the removed tree was a tree required by ordinance (such as a landscape buffer or parking lot shade tree), the equivalent replacement must be the largest tree reasonably available. If on-site replacement is not feasible, the property owner may be required to pay the equivalent value into the city's tree preservation fund.
Failure to complete required tree replacement may result in code enforcement action, fines, and liens. The city may pursue enforcement through the Special Magistrate process.
