Aurora collects development impact fees for new dwelling units under Aurora City Code Chapter 138 (Development Fees). ADU permits trigger building permit fees, plan-review fees, Aurora Water tap fees, and use-tax on construction materials. The city has not adopted a per-unit ADU surcharge or a low-income waiver. State law HB24-1152 allows local governments to keep impact fees on ADUs but encourages waivers for small or affordable units; Aurora is studying fee structures as part of the post-2025 UDO update.
ADU fees in Aurora stack as follows. The building permit fee scales with valuation under the schedule in Aurora City Code 22-87, typically $800-$2,500 for a 600-800 sq ft ADU. Plan-review fees add roughly 65% of the building permit fee. Aurora Water tap fees are the largest single charge: a residential 3/4-inch tap currently runs around $14,000-$18,000 if the ADU has a separate meter, but ADUs sharing the main house meter pay no new tap fee. Sewer connection fees are similar in scale. Drainage and traffic impact fees under Chapter 138 apply to net new units; the rate is published annually in the Aurora Fee Schedule. Use-tax on construction materials is 3.75% of estimated material cost, collected at permit. Colorado HB24-1152 preserves local impact-fee authority but Section 31-23-302(8) as amended encourages fee waivers for ADUs under 750 sq ft and for income-qualified projects through the ADU Supportive Jurisdiction certification administered by the Division of Local Affairs. Aurora has not yet adopted a categorical ADU waiver but the Engage Aurora process is reviewing options. School-district impact fees do not apply because Colorado does not authorize them.
Permits will not issue until fees are paid in full. Construction without payment is a misdemeanor under Aurora City Code Chapter 22 prosecuted in Municipal Court with fines up to $2,650 per day. Unpaid use-tax is collected through liens. Connecting to Aurora Water without paying the tap fee can result in service termination and a $500-$1,000 reconnection charge plus all unpaid fees.
