Fort Wayne and Allen County do not levy a general residential impact fee on ADUs. Indiana is a Dillon Rule state, and local impact fees are authorized only under the Indiana Impact Fee Act, IC 36-7-4-1300 et seq., which requires a published Zone Improvement Plan and a community-needs analysis before any fee may be imposed. Fort Wayne has not adopted a general residential impact fee, so ADUs do not pay separate transportation, parks, school, or general impact charges. Costs to permit an ADU in Fort Wayne are limited to: (1) the $150 DPS Administrative ADU Zoning Permit fee; (2) Allen County Building Department permit fees calculated on construction valuation under the Indiana Building Codes adopted in 675 IAC; (3) separate electrical, plumbing, and mechanical permit fees; (4) plan-review and inspection fees; and (5) City Utilities of Fort Wayne tap and connection fees for new water and sewer service connections (which can range from a few hundred to several thousand dollars depending on whether new laterals or meters are installed). Fort Wayne and Allen County synchronized their permit-fee schedules in 2024 (Fort Wayne Business, Sept. 10) to reduce confusion for builders working across the city-county boundary. Fort Wayne Community Schools and Northwest Allen County Schools do not charge an impact fee; Indiana school districts have no statutory authority to do so.
No impact-fee violation exists since no impact fee is charged. Failure to pay the $150 DPS permit fee, building-permit fees, or utility tap fees prevents issuance or connection. After-the-fact permits are doubled under ACBD policy.
