Newark's primary residential development charge is the affordable-housing inclusionary requirement codified at Chapter 41:21 (Inclusionary Zoning for Affordable Housing). That ordinance is triggered only by new residential construction of more than 30 dwelling units, or substantial rehabilitation of more than 40 dwelling units, when paired with one of several discretionary approvals (variance relief, redevelopment-plan change, city-owned land, or MX-3 zone). A single accessory dwelling unit on an existing residential lot falls far below those thresholds and is therefore not subject to the 20% set-aside or to the payment-in-lieu schedule ($50,000 / $20,000 / $15,000 per required affordable unit by income tier). New Jersey's statewide non-residential development fee (2.5%) authorized by N.J.S.A. 52:27D-329.2 likewise does not apply to residential ADUs. The fees a Newark ADU applicant should actually budget for are: (1) the Chapter 41 zoning / conditional-use application and escrow fees set by the Central Planning Board, and (2) the standard NJ UCC subcode permit fees (building, electrical, plumbing, fire) charged by the Newark Construction Code Official under the schedule published in the City Code. Sewer-connection or water-meter fees from Newark Water and Sewer Utilities may apply if new service is run.
Failing to pay applicable UCC permit and Planning Board escrow fees results in permit denial and stop-work orders. Misrepresenting an ADU project as part of a larger development to avoid Chapter 41:21 obligations could constitute a zoning violation subject to daily fines.
