Newark enforces the NJ Uniform Fire Code (N.J.A.C. 5:70) and Chapter 11:1 of the municipal code for smoke and carbon monoxide alarm requirements. Smoke alarms must be installed on every level of a dwelling including basements, and outside each separate sleeping area. Carbon monoxide alarms are required in all dwelling units that contain a fuel-burning device (furnace, water heater, stove) or have an attached garage, installed in the immediate vicinity of sleeping areas. CO alarms may be battery-operated, hard-wired, or plug-in type and must be listed per UL-2034. Before any sale, lease, or change of occupancy, the owner must obtain a Certificate of Smoke Alarm, Carbon Monoxide Alarm, and Portable Fire Extinguisher Compliance from the local fire official (N.J.A.C. 5:70-2.3). A portable fire extinguisher is also required in each dwelling unit. Tampering with or disabling any smoke detector is a code violation.
Failure to maintain working detectors can result in fines. Certificate of compliance required before sale or lease.
