Newark, NJ Animal Ordinances: Veterinary Clinic Zoning (2026)

Section 41:2-2 of Title XLI, Newark's Zoning and Land Use Ordinance adopted November 1, 2023 by Ordinance No. 6PSF-E, defines VETERINARY CLINIC OR OFFICE as a commercial facility where animals are brought in for medical treatment but are not kept overnight, and states that once a veterinary clinic or office exceeds 3,500 square feet of floor area, it is reclassified as a VETERINARY HOSPITAL, defined as a facility where animals may remain overnight for observation, further treatment or recuperation. Table 4-2, governing the Commercial and Mixed-Use Districts, permits Veterinary Clinic or Office (P) in all six zones: C-1, C-2, C-3, MX-1, MX-2 and MX-3.

Veterinary Hospital is far more restricted on the same table, marked not permitted (-) in C-1, C-2, MX-1, MX-2 and MX-3, and permitted (P) only in the C-3 zone. Neither use appears in Table 4-1 for the Residential Districts, so under Section 41:4-0 both a veterinary clinic and a veterinary hospital are prohibited in every residential zone, R-1 through R-6. This means a practice that plans to board animals overnight, or that simply grows past the 3,500-square-foot threshold, must relocate to the C-3 zone to remain compliant, even if it started as a compliant clinic in a zone like C-1 or MX-1 that does not allow hospitals.

Any veterinary use is also subject to Chapter 41:5's building bulk and design standards and Chapter 41:7's off-street parking requirements for the district in which it operates.
