The applicant submits the ADU permit application through Carlsbad's online Energov portal with a building permit application, site plan, floor plans, exterior elevations, the Carlsbad ADU checklist, a Hold Harmless Agreement, and (for Coastal Zone lots) the Coastal Development Permit application under CMC 21.201. California Government Code 65852.2(b)(1) requires the city to approve, deny, or request corrections within 60 days of a complete application; the timer pauses if corrections are needed. Carlsbad also offers a Pre-Approved ADU Plans program with five vetted plan sets that streamline permitting to roughly 30 days. The application is concurrently routed to Building, Planning, Fire, Engineering, and (if applicable) Coastal Zone staff. Once approved, the building permit is issued and inspections proceed under the California Residential Code.
Constructing or occupying an ADU without a building permit is a violation enforced by Carlsbad Code Enforcement under CMC 18.04 and 21.44. Penalties include stop-work orders, administrative citations starting at $100 (CMC 1.08), daily continuing-violation fines, and an order to restore or legalize the structure.
