Carlsbad Municipal Code Chapter 21.46 (Yards) regulates fence height and placement in residential zones. Fences over 6 feet require a building permit under CMC Title 18, and any fence within a corner vision triangle must not exceed 42 inches.
Under CMC 21.46.130, walls and fences in residential zones cannot exceed 6 feet behind the front yard setback or 42 inches within the required front yard. At corner lots, no fence, hedge, or obstruction higher than 42 inches above grade is permitted in the triangular vision area to maintain driver sight lines. The 2022 California Building Code adopted by Carlsbad in CMC Title 18 requires a building permit for any fence or wall over 7 feet (CBC 105.2). Pool barriers have separate requirements under California Health and Safety Code 115922 (minimum 60 inches with self-closing/self-latching gate). Fences in the Coastal Zone (Chapter 21.203) may also require a Coastal Development Permit if they affect public views.
Constructing a fence over 6 feet without a permit is a code violation under CMC 18.04 and carries administrative citations starting at $100 for the first offense, $200 for the second, and $500 for each subsequent violation under CMC 1.08.080. The city may also order removal at the owner's expense.
