Detached ADUs are limited to 1,200 sq ft, attached ADUs to 1,200 sq ft or 50% of the primary dwelling area (whichever is less), and JADUs are limited to 500 sq ft within an existing or proposed single-family home (Gov. Building an ADU without permits violates HMC Chapter 10 (Zoning) and HMC Chapter 9 (Building Regulations). Hayward Code Enforcement (Neighborhood Preservation Division) may issue stop-work orders, administrative citations under HMC 1-7 starting at $100 for the first violation, and require double permit fees on a legalization application. Unpermitted ADUs can prevent property sales, refinancing, and rental income, and may result in an order to demolish.
