Following Rhode Island's 2024 statewide ADU reform (HB 7062Aa, codified at R.I. Gen. Laws Section 45-24-37(j)), Providence allows one ADU per residentially zoned lot by right. The City's Department of Inspection and Standards published its ADU Guidelines in February 2025 to implement the state law. ADUs may be Internal (within or attached to the principal dwelling) or Separate (detached). Maximum gross floor area is 900 sq ft for a studio or one-bedroom, and 1,200 sq ft for a two-bedroom unit. The state law caps the City from requiring more than the size standards in 45-24-37(j) on owner-occupied single-family lots. Applicants file through Providence's e-Permitting portal. Required permits include a building permit, plus separate electrical, plumbing, and mechanical permits for any new utility work performed by Rhode Island-licensed tradespeople. A Certificate of Occupancy from the Department of Inspection and Standards is required before the ADU can be occupied. Properties in Providence Historic District Commission (PHDC) districts (College Hill, Broadway, Armory, etc.) require additional PHDC review for exterior alterations visible from the public right-of-way.
Constructing or occupying an ADU without a building permit and Certificate of Occupancy violates the Rhode Island State Building Code (adopted under R.I. Gen. Laws Section 23-27.3) and the Providence Zoning Ordinance. The Department of Inspection and Standards can issue stop-work orders, daily fines, and require removal of unpermitted work. PHDC violations in historic districts trigger separate enforcement under Chapter 27 of the City Code. Unpermitted electrical, plumbing, or gas work commonly voids homeowner insurance.
