Tiny home rules in Providence, RI β covering tiny houses on wheels (THOWs), park model RVs, and tiny home on foundation builds β determine where they are legal and how they get permitted.
Rhode Island has adopted the 2021 IRC with Appendix AQ (Tiny Houses), so a foundation-built tiny home in Providence must meet RISBC-1 standards and Chapter 27 zoning. Detached tiny homes used as second units must qualify as Accessory Dwelling Units under RIGL 45-24-37 and 45-24-73, must be on a foundation, and may not be used as short-term rentals.
Providence does not have a separate tiny-home ordinance; tiny homes are regulated through the RI Statewide Building Code (RISBC-1, adopting the 2021 IRC with Rhode Island amendments, including Appendix AQ for tiny houses) and through Chapter 27 of the Providence Zoning Ordinance. A tiny house under Appendix AQ is generally a dwelling 400 square feet or less in floor area; it must still be built on a permanent foundation, comply with egress, ceiling-height, and life-safety provisions of the IRC, and obtain a building permit from the Providence Department of Inspection & Standards through the state e-permitting portal. Tiny homes used as second units on residential lots are governed by Rhode Island's statewide Accessory Dwelling Unit law (RIGL 45-24-37 and 45-24-73), which Providence implements through its zoning ordinance. ADUs may not exceed 900 sq ft (studio/one-bedroom) or 1,200 sq ft (two-bedroom), must be attached to a foundation, may not be mobile, and may not be offered for tourist or transient (short-term) rental. Tiny houses on wheels (THOWs) are not recognized as permanent dwellings under the IRC. Confirm zone, lot, and permit requirements with Inspection & Standards at 401-680-5201.
Occupying a tiny home built without a permit, on wheels, or without a permanent foundation violates the RI Statewide Building Code and Chapter 27. Renting an ADU-classified tiny home on Airbnb or Vrbo violates RIGL 45-24-37/45-24-73 and Providence's ADU regulations. Enforcement may include stop-work orders, removal, and Housing Court action.
