Wichita regulates accessory dwelling units under the Wichita-Sedgwick County Unified Zoning Code (UZC). ADUs are permitted in most SF districts subject to size, setback, and building permit requirements. Permits are filed through the Office of Central Inspection (OCI) at the City Hall Permit Center. Kansas has no statewide ADU framework β all rules are local.
ADUs (called accessory dwelling units or secondary dwelling units in the Wichita-Sedgwick County UZC) are governed by Section IV.C of the zoning code. Permitted accessory dwellings are allowed in SF-5, SF-6, and SF-20 single-family districts as a permitted accessory use, provided the lot meets minimum area requirements and the ADU is subordinate in size to the primary dwelling. The Office of Central Inspection administers permits at 271 W 3rd St N, Suite 101. Required: building permit application, site plan showing setbacks, floor plan, structural drawings, and trade permits for plumbing/electrical/mechanical. Building must meet the 2018 International Residential Code as adopted by Wichita with local amendments. Setbacks typically follow underlying district rules (commonly 7 ft side, 25 ft rear). Detached ADUs are reviewed by Metropolitan Area Planning Department. Plan review averages 10-15 business days. Tornado-prone region: structures must meet IRC wind-load requirements for 115 mph wind speeds per ASCE 7. No statewide Kansas ADU statute exists β KSA 12-741 et seq. leaves zoning to local control.
Construction without a permit triggers stop-work orders, doubled permit fees, and code-enforcement citations under Wichita Code Chapter 18. Habitable structures without certificates of occupancy cannot be legally rented. Persistent zoning violations can result in municipal court fines up to $1,000 per occurrence and daily recurring fines under Section 1.04.040.
