Wichita allows long-term rental of ADUs subject to owner occupancy of one of the two dwellings on the lot. Long-term ADU rentals are allowed in SF districts as long as the owner-occupancy condition is met. There is no rental cap, no minimum lease term required by city ordinance, and no rental registration program for typical long-term leases. Short-term rental of an ADU (defined as rentals under 30 consecutive days) falls under Wichita's STR ordinance adopted under Code Chapter 3.62, which requires an annual STR permit, payment of transient guest tax (currently 6%), and adherence to occupancy and parking standards. Inspections by OCI may be required before STR licensing. Kansas state law (KSA 12-187 et seq.) authorizes municipalities to levy transient guest taxes and regulate STRs. HOA covenants in many newer Wichita subdivisions further restrict rental terms.
Unpermitted STR operation can result in fines up to $1,000 per day under Wichita Code 1.04.040, plus collection of unpaid transient guest tax. Long-term rentals without owner occupancy violate the UZC ADU conditions and can lead to revocation of the certificate of occupancy. Listing-platform takedown notices may be issued through the city's STR enforcement program.
