Local Law 18 of 2022 (NYC short-term rental registration) prohibits short-term rentals in any dwelling unit unless the host is present and the unit is registered with the Mayor's Office of Special Enforcement. ADUs and basement units are not eligible for STR registration.
Under Local Law 18 of 2022, all short-term rentals (under 30 nights) in NYC must be registered with the Mayor's Office of Special Enforcement (OSE). Registration requires that the host occupy the dwelling unit during the stay (host-presence rule) and that no more than two guests be allowed. ADUs and basement units created under the Local Law 22 of 2024 pilot are excluded from STR registration because they are not the host's primary residence. Booking platforms (Airbnb, VRBO) must verify a valid OSE registration number before listing. Long-term rentals (30+ nights) are not subject to Local Law 18 and are governed by the standard NYC Rent Stabilization Law where applicable, or the Multiple Dwelling Law.
OSE issues civil penalties up to $5,000 per violation under NYC Admin Code 26-3105. Booking platforms face fines up to $1,500 per illegal listing. Repeat hosts can face HPD vacate orders and DOB ECB violations.
