Small sheds under 100-144 square feet are generally permit-exempt in Suffolk County towns but must still meet setback rules (typically 3-5 feet from side and rear property lines). Sheds over 144 sq ft or those on permanent foundations require building permits. Electrical or plumbing connections always require separate permits.
Brookhaven Chapter 85 exempts sheds under 144 sq ft and 10 feet tall from building permits when placed in rear yards with 4-foot setbacks. Islip and Huntington have similar 100-144 sq ft exemptions. Any shed with electrical service, plumbing, or foundation footings requires a building permit and inspection. Sheds cannot be used as dwellings under any town code. In Southampton and East Hampton, larger garden sheds and pool houses often require Architectural Review Board approval.
