A shed in Islip may be built without a permit if it is 144 square feet or less, no more than 8 feet high, has no electric or plumbing, is the only shed on the lot, and meets setbacks; larger or taller sheds require a building permit.
The Town of Islip Division of Building publishes its shed and accessory structure rules in its official Zoning FAQ (islipny.gov) and in Town Code Chapter 68. Sheds and similar accessory structures (detached garages, pergolas, cabanas, gazebos) may not be located in a primary front yard except on Fire Island and are subject to size-based setbacks. Front-yard placement behind the front face of the house is 4 feet for structures 6 feet or less in height and 20 feet for structures over 6 feet. Maximum accessory-structure height is 14 feet in residential zones AAAB, BAA, AAA, AA, A, B and CAA, and 18 feet in GST, CA and RRD. Accessory buildings may not occupy more than 25% of the rear yard, and a minimum of 40% of the rear yard must remain landscaped earth (not concrete or asphalt). Residential accessory structures of 499 square feet or less (249 in Residence BAA) are not counted toward Floor Area Ratio unless improved with plumbing fixtures, in which case the gross floor area always counts toward FAR.
A shed that exceeds the no-permit thresholds, lacks setbacks, or pushes rear-yard occupancy past the limit (so less than 40% of the rear yard remains landscaped earth) must be removed or legalized through a Zoning Board of Appeals variance application. Building without a required permit subjects the owner to Town of Islip code enforcement and penalties under Chapter 68.
