NY Agriculture and Markets Law Section 107(5) expressly preempts local breed-specific legislation: no county, town, city, or village in New York State may restrict dogs by breed. This prevents Rockland municipalities from banning pit bull terriers, rottweilers, dobermans, or any other specific breed. Instead, NY uses an individual dangerous-dog process under Ag Markets Section 123, which requires a hearing before a town justice based on specific behavior (unprovoked attack, serious injury, or menacing behavior). A dog found dangerous can be ordered muzzled, leashed, fenced, neutered, or in extreme cases euthanized. Landlords, HOAs, and condo boards can still impose private breed restrictions on their properties, and homeowner insurance carriers often exclude certain breeds. Rockland SPCA and town dog control officers handle complaints. NY Public Housing Law limits breed restrictions in some public-housing contexts.
