Federal EPA Renovation, Repair, and Painting (RRP) rule (40 CFR Part 745 Subpart E) applies to all renovations in homes, child care facilities, and schools built before 1978 where lead-based paint may be disturbed. Contractors performing these renovations in unincorporated Clark County must be EPA-certified firms with at least one certified renovator on site. Work must follow lead-safe work practices including containment, dust control, and cleaning verification. Required Renovate Right pamphlets must be provided to residents before work begins. Penalties for non-compliance can reach federal fines of over 37,000 dollars per violation per day. Nevada does not have a state-level lead abatement program exceeding federal rules, but the Nevada Department of Public and Behavioral Health runs the Childhood Lead Poisoning Prevention Program. Because the Las Vegas Valley experienced rapid growth after 1978, pre-1978 housing is concentrated in older neighborhoods of Sunrise Manor, East Las Vegas, and some parts of Paradise; master-planned communities like Summerlin South and Mountains Edge are all post-1978 and not subject to RRP.
Uncertified renovation of pre-1978 housing can trigger EPA federal penalties. Disturbance of lead paint creating child exposure can result in civil liability and NDPBH case investigation. County building permits may be denied without documentation.
