Lead paint in Converse pre-1978 homes is regulated by federal Title X and the EPA RRP Rule. Sellers and landlords must disclose hazards. Contractors disturbing paint must be Lead-Safe certified.
Federal lead-based paint regulations override state and local rules for pre-1978 housing. The Residential Lead-Based Paint Hazard Reduction Act (42 USC 4851, commonly Title X) requires sellers and landlords of target housing to disclose known lead-based paint and lead hazards, deliver the EPA-approved pamphlet Protect Your Family from Lead in Your Home, and give purchasers a 10-day opportunity to conduct a risk assessment. EPA 40 CFR Part 745 Subpart E (the RRP Rule) requires contractors who disturb more than 6 square feet of painted surfaces interior or 20 square feet exterior in pre-1978 housing or child-occupied facilities to be Lead-Safe certified by the EPA. Certified renovators must use lead-safe work practices including plastic containment, HEPA vacuuming, and proper cleaning verification. HUD requirements apply to federally assisted housing. Texas Department of State Health Services (DSHS) regulates lead inspectors and risk assessors under the Texas Environmental Lead Reduction Rules (25 TAC Chapter 295, Subchapter H). Homeowners performing DIY work on their own residence are exempt from the RRP certification requirement but must still protect children and pregnant women from lead dust. Converse has no separate local lead paint ordinance, deferring to federal and state rules.
Violations of the EPA RRP Rule can result in civil penalties up to approximately $46,000 per violation per day (inflation-adjusted). Disclosure failures under Title X can result in triple damages plus attorney fees to purchasers or tenants. Children exposed to lead can suffer permanent neurological harm, leading to substantial tort liability.
