Egg Harbor Township's setback requirements are contained in Chapter 225 (Zoning) of the Township Code, specifically Article II District Regulations and its Schedule of Minimum Area, Yard and Building Requirements. Setbacks vary by district β RS-1 and RS-2 single-family zones have larger required yards than RR or commercial districts. The Zoning Officer (Sarah Schaffer) reviews applications.
Chapter 225 of the Egg Harbor Township Code establishes the township's zoning districts and dimensional requirements. The Schedule of Minimum Area, Yard and Building Requirements specifies front, side, and rear yard setbacks for each district. RS-1 single-family zones generally require 40-foot front yards, 15-foot side yards, and 30-foot rear yards, while RS-2 zones reduce these to 30/10/25 feet. The Rural Residential (RR) and Pinelands zones have larger setbacks reflecting state Pinelands Commission requirements. Corner-lot lots count both street frontages as front yards. Accessory structures (sheds, detached garages, pools) follow separate, generally smaller setbacks under Β§225 accessory-use provisions. All new construction, additions, fences over 6 feet, and most accessory structures require a Zoning Permit before a Construction Permit.
Construction encroaching into required yards triggers a zoning violation. The Zoning Officer can issue a stop-work order, deny a certificate of occupancy, and refer continued violations to the Township Construction Department for daily-fine enforcement. Variances are heard by the Zoning Board of Adjustment.
