Birmingham's zoning ordinance requires applicants to demonstrate compliance with state buffer rules and obtain Zoning Board of Adjustment conditional-use approval. The city may impose additional separation between dispensaries themselves to prevent clustering. Any change in adjacent land use that creates a violation may trigger nonconforming-use review at license renewal. Operators bear the burden of proving compliant distances at every step.
Operating within a buffer zone is grounds for AMCC license revocation and city zoning enforcement, with daily fines up to $500 plus injunctive relief and possible permanent closure of the dispensary location.
