Birmingham regulates carports under Appendix D (Zoning Ordinance), Title 2 Article VI Section 20 and the city Building Code. A carport in any yard other than the rear yard must be attached to the principal dwelling and built of compatible materials. Rear-yard accessory structures must sit at least three feet from any side or rear lot line and may not occupy more than 30 percent of the required rear yard.
Birmingham's Zoning Ordinance (Appendix D of the Code of Ordinances), Title 2 - Zone Districts, Article VI - Supplementary Regulations and Modifications, Section 20 governs hipped and similar accessory uses including carports. Carports located in a front or side yard must be physically attached to the principal structure and constructed of materials compatible with the main dwelling's facade and roof. Detached carports are limited to the rear yard, where Article VI also caps total accessory-structure coverage at 30 percent of the required rear yard and requires a minimum three-foot setback from any side or rear lot line. When a garage or carport is entered from an alley, it must sit at least five feet from the alley line. Building permits are issued by the Department of Planning, Engineering & Permits (PEP) at City Hall Room 210, 710 20th Street North, under the city's adopted International Residential Code and International Building Code. Setback dimensions vary by zoning district (R-1, R-2, R-3, etc.) so confirm your specific property's setbacks with PEP before construction. Carports in local historic or commercial revitalization districts require additional Urban Design review.
Building a carport without a permit, in the wrong yard, or within the three-foot setback violates Appendix D Title 2 Article VI Section 20 and the building code. PEP can issue stop-work orders, require removal or after-the-fact permits, and refer cases for municipal court fines.
