Birmingham does not impose a blanket residential overnight on-street parking ban, but Title 10, Chapter 9 of the City Code prohibits leaving a vehicle parked on any public street or way for more than 48 hours, and a vehicle accumulating unpaid citations is subject to towing. Unlike many cities, Birmingham has no city-wide prohibition on simply leaving a passenger car parked on a residential street overnight. Instead, the controlling time limit is the 48-hour rule in Title 10, Chapter 9 (Stopping, Standing and Parking): a vehicle may not remain parked upon any public street or other public way for more than 48 hours, and disabled, broken-down or inoperative vehicles must be removed within a reasonable period not exceeding 48 hours. Vehicles left beyond that period - or accumulating unpaid parking citations - may be cited or towed. In metered downtown districts, overnight parking is generally unrestricted once paid enforcement hours end, but drivers must follow posted signs and any time-limit signage. Birmingham's enforcement policy provides that a vehicle with three unpaid parking violations will be towed on its fourth violation.
Leaving a vehicle parked on a public street longer than 48 hours is a violation of Title 10, Chapter 9 and exposes the vehicle to citation and towing as an abandoned or improperly parked vehicle. Accumulated unpaid citations trigger towing on the fourth violation. Recovery requires payment of outstanding citations plus towing and storage charges.
