Vestavia Hills regulates carports as accessory structures under Section 4.4 of the Zoning Code (Appendix A, Article 4 - General Regulations). A detached accessory structure must be located only in the rear yard, set back at least fifteen feet from the rear lot line, separated by at least ten feet from the principal dwelling, and may not exceed one story or sixteen feet in height. Side-yard setbacks match those required of the principal structure in the underlying district.
Vestavia Hills Zoning Code Appendix A Article 4 (General Regulations), Section 4.4 (Accessory Structures), governs detached carports, garages, sheds, and similar structures. Detached accessory structures may be located only in the rear yard and must sit at least fifteen feet from the rear lot line, with side-yard setbacks equal to those required of the principal structure in the applicable zoning district. Each detached accessory structure must be at least ten feet from the principal dwelling, providing fire separation consistent with the building code. Maximum height is sixteen feet and one story; greater heights require Special Exception approval from the Board of Zoning Adjustment. Detached accessory structures must be constructed of building materials of the same type and kind as the principal structure, so a carport with metal posts and an open roof on a brick-veneer home generally cannot be placed without matching materials or obtaining design relief. Construction of an accessory structure cannot begin until construction of the principal building has commenced, and the accessory structure cannot be used unless the principal building is also in use. An attached carport - one that is structurally part of the principal dwelling - is treated as part of the principal structure and must meet the front, side, and rear setbacks of the underlying residence district under Article 7 (Use and Construction Regulations). Building permits and inspections are administered by the Vestavia Hills Department of Building Safety under the adopted International Residential Code (Alabama amendments) and Chapter 7 of the Code of Ordinances. Lots in the Cahaba Heights overlay or any local historic overlay receive additional design review.
Building a carport without zoning clearance and a Building Safety permit, placing a detached carport in the front or side yard, exceeding sixteen feet or one story without Special Exception approval, or violating the ten-foot separation from the principal dwelling violates Section 4.4. Enforcement is by the Department of Building Safety; remedies include stop-work orders, after-the-fact permitting, mandatory removal, and the general municipal penalty under Chapter 1 (fines up to $500 per violation per day, per Alabama Code Section 11-45-9).
