Several subsections of Birmingham City Code section 11-8-23 target vehicle noise. Subsection (1) prohibits sounding any horn, electronic alarm or signal device on a motor vehicle for more than 30 seconds constantly, except as a danger warning when and as required by city ordinances or the Code of Alabama, and also bars unreasonably loud or harsh signal sounds and sounding signals when traffic is held up. Subsection (4) requires that internal combustion engine and motor-vehicle exhaust discharge only through a muffler or other device that effectively prevents loud or explosive noises. Subsection (10) prohibits operating a vehicle that, by its state of repair or the manner in which it is loaded, creates loud and unnecessary grating, grinding, rattling, roaring or other noise. Sound from a vehicle that is plainly audible 10 feet away is prima facie evidence of a violation under subsection (8)b.
Vehicle-noise violations are nuisances prosecuted in Birmingham Municipal Court. Birmingham City Code section 1-1-6 caps the general penalty at a $500 fine or six months imprisonment, or both.
