Because recreational cannabis is illegal in Texas, Plano has no permitted dispensaries to buffer. State drug-free zone enhancements still apply: marijuana offenses within 1000 feet of schools, playgrounds, or daycares carry stiffer penalties.
Texas Health and Safety Code Section 481.134 creates drug-free zones that double or otherwise enhance penalties for marijuana possession, delivery, or manufacturing offenses occurring within 1000 feet of a school, public playground, daycare, youth center, or school bus, and within 300 feet of public swimming pools or video arcades. Plano has many public and private schools, parks with playgrounds, and licensed daycare facilities, so most of the city falls within at least one drug-free zone. Plano also enforces Chapter 14 drug-free workplace and drug paraphernalia provisions. Because no licensed dispensary is allowed under state law, the city has no separate cannabis retail buffer ordinance.
A cannabis offense inside a Texas drug-free zone can elevate the penalty by one degree, add mandatory minimum confinement, and forfeit eligibility for community supervision in some cases under HSC 481.134.
