Lincoln's zoning code does not yet contain a use category for cannabis cultivation, processing, or testing. Title 27 amendments are expected once the state Medical Cannabis Commission begins issuing licenses.
Lincoln Municipal Code Title 27 (Zoning) currently has no use category specifically authorizing cannabis cultivation, processing, manufacturing, or laboratory testing. Until amendments are adopted, any such operation would be unauthorized regardless of state license status. The Planning Department and City Council will likely propose I-1 or I-2 industrial-zone overlays for cultivation and processing, with retail dispensaries regulated separately. Public hearings before the Planning Commission and Council are required for all Title 27 amendments. Operators should track Council agendas and contact Lincoln Planning early during site selection.
Operating an unpermitted cannabis facility violates state law and Lincoln zoning. The city can issue stop-work orders, revoke business licenses, and pursue injunctive relief.
