HOA assessment rules in Lincoln are governed by association bylaws and Nebraska law. Under Neb. Rev. Stat. 52-2001, associations may place liens on properties for unpaid assessments. Liens must be recorded with the county Register of Deeds and include the dollar amount owed. Lien enforcement must begin within three years of the assessment due date. Homeowners may request statements of unpaid assessments, and the association must respond within ten business days. Purchasers of property after September 6, 2013 may be required to pay up to six months of assessments into escrow.
