CC&R enforcement in Lincoln HOAs is governed by the association's Declaration of Covenants, Conditions, and Restrictions and the Nebraska Nonprofit Corporation Act (Neb. Rev. Stat. 21-1901 et seq.). HOA boards have the authority to enforce community rules through fines, suspension of privileges, and legal action. Nebraska courts uphold CC&R enforcement when restrictions serve legitimate purposes and are applied uniformly. The association must provide notice and an opportunity to be heard before imposing fines or sanctions.
