Architectural review authority for Lincoln HOAs is established through each community's Declaration of Covenants, Conditions, and Restrictions (CC&Rs). Nebraska courts have consistently upheld HOA architectural restrictions when they serve a legitimate purpose, are within the association's power under the CC&Rs, and do not violate law or public policy. Common restrictions include exterior paint colors, fencing styles, roofing materials, and structural modifications. The architectural review committee (ARC) must apply standards uniformly and provide written decisions.
