Milwaukee's zoning ordinance (Milwaukee Code Ch. 295) does not currently include any cannabis-retail use class because Wisconsin's controlled-substances framework under Wis. Stat. Ch. 961 keeps marijuana retail unlawful. The Common Council has periodically adopted resolutions urging state legalization, but absent a state framework, no commercial cannabis zoning exists. Hemp-derived CBD retail under Wis. Stat. Β§94.55 is permitted as ordinary retail subject to base zoning rules in Ch. 295. If Wisconsin legalizes, Milwaukee would need to amend Ch. 295 to define cannabis-retail districts, set buffer zones, and process conditional-use permits through the Plan Commission and Common Council. Neighboring Illinois and Michigan markets currently draw Wisconsin cannabis consumers across state lines.
Operating an unlicensed cannabis retail outlet violates state controlled-substances law, not zoning. Hemp/CBD shops are subject to standard Ch. 295 enforcement for use, signage, and occupancy.
