Milwaukee Fire Code (Chapter 215) adopts the 2015 IFC with local amendments. IFC 308.1.4 prohibits open-flame cooking devices and LP-gas tanks over 1 lb on combustible balconies of multi-family buildings (three or more units). Charcoal grills must be 10 feet from combustible buildings. Wisconsin DSPS SPS 314 also applies. Cold-weather grilling is common in Milwaukee but balcony rules still apply.
Milwaukee Code Chapter 215 (Fire Prevention) adopts the 2015 International Fire Code with city amendments. IFC 308.1.4 prohibits open-flame cooking devices (gas, charcoal, electric over 5 kW) on combustible balconies and within 10 feet of combustible construction in buildings with three or more dwelling units. Exceptions exist for buildings fully protected by NFPA 13 or 13R automatic sprinkler systems and non-combustible balconies. LP-gas containers exceeding 1 pound capacity are prohibited on multi-family balconies. Wisconsin DSPS SPS 314 (Fire Protection) provides additional state-level fire safety requirements. Charcoal and solid-fuel grills are subject to the same 10-foot clearance from combustible construction. Milwaukee's cold climate makes year-round grilling common; tailgating at Brewers and Bucks games is a major local tradition, regulated separately at stadium parking areas. Multi-family housing in Brewers Hill, the East Side, and Walker's Point typically prohibits balcony grilling per IFC and lease terms. Single-family detached homes in Bay View, Riverwest, and Washington Heights have fewer constraints.
Chapter 215 violations carry forfeitures of $100-$1,000 per offense. The Milwaukee Fire Department may issue immediate stop-use orders, vacate orders, and refer for prosecution. Wisconsin DSPS SPS 314 violations are state-level matters. Multi-family landlords typically include lease termination rights for grill violations. Fires causing damage create civil liability and potential criminal charges under Wisconsin Statute 943.02 (Arson).
