Under SDMC Β§141.0614 and Β§141.1004, every commercial cannabis premise must sit in a permitted zone for its license type. Marijuana Outlets, the city's term for cannabis retailers, are allowed only in commercial and selected industrial zones such as CC, CO, CR, CV, IL, IH, and IS, with a Conditional Use Permit and 1,000-foot sensitive-use buffers. Cannabis Production Facilities, covering manufacturing, distribution, and indoor cultivation, require an industrial zone IL, IH, or IS plus CUP. Each Council District has a four-outlet limit under prior caps. Existing legal nonconforming uses are not grandfathered into new license types.
Operating in a non-permitted zone makes a premise ineligible for licensing. Unlicensed operations face daily fines under SDMC Β§11, civil injunction, utility shut-off proceedings, and possible misdemeanor charges, plus state Department of Cannabis Control enforcement against any state license.
