Kentucky's medical cannabis program does not currently authorize home delivery; cardholders must purchase in person at a licensed dispensary, and unlicensed delivery remains a criminal trafficking offense under KRS 218A.
KRS Chapter 218B and the OMC's implementing regulations launched the medical cannabis program with in-person dispensary purchase only. Unlike states with mature programs, Kentucky has not authorized cannabis delivery to patient residences, and 915 KAR 1:070 requires sale at the licensed premises by a credentialed dispensary agent. Caregivers may pick up on behalf of registered cardholders with proper credentialing. Any third-party or app-based delivery service operating in Lexington without OMC authorization violates state law and exposes drivers to KRS 218A trafficking charges. The legislature could authorize delivery in future amendments, but as of 2026 it remains prohibited.
