Unlike Missouri or Virginia, Kentucky's KRS Chapter 218B explicitly excludes patient home cultivation from the medical cannabis program. Only OMC-licensed Tier I-IV cultivators may grow plants, in secured indoor or greenhouse facilities meeting 915 KAR 1:080 security standards. A registered cardholder caught growing personal plants faces the same penalties as any unlicensed grower under KRS 218A.1422 (Cultivation of Marijuana), a Class B misdemeanor for fewer than five plants and a Class D felony for five or more. Lexington police and the Bluegrass Narcotics Task Force enforce these provisions; the medical card provides no defense for cultivation charges.
