NY MRTA gave every city, town, and village a one-time right to opt out of adult-use retail dispensaries and on-site consumption by December 31, 2021 (Cannabis Law Β§131). Several Rensselaer County towns opted out including Brunswick, Pittstown, and others; Troy, Rensselaer, and East Greenbush opted in. Municipalities that opted out may rescind but cannot newly opt out. Opt-in municipalities may still impose time/place/manner restrictions under Cannabis Law Β§131(3) β reasonable proximity rules, operating hours, and zoning district limits. State proximity rules (Cannabis Law Β§72): 500 ft from schools and 200 ft from houses of worship. Licenses issued by NY Office of Cannabis Management (OCM). Conditional Adult-Use Retail Dispensary (CAURD) licenses prioritized justice-involved applicants.
Operating without OCM license: Class A misdemeanor plus civil penalty up to $20,000. Zoning violations: $250-$1,000 per Troy Ch. 285 or town code. Schools/worship buffer violation: license denial or revocation.
